Terms of Service
Last updated: November 2, 2026
Agreement to these terms
These Terms of Service ("Terms") apply when you use embodi3sports.com (the "Site") or take part in coaching from Embodi 3 LLC ("Embodi³," "we," "us," or "our"). "You" means the person using the Site. When a parent or guardian enrolls an athlete, "you" also means the parent or guardian.
By using the Site, filling out a form, booking a call, or joining a program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.
If you join a program, you will also sign a program agreement. The program agreement covers prices, payments, refunds, device deposits, and returns. If the program agreement and these Terms disagree, the program agreement controls.
What we do
Embodi³ offers coaching that pairs direct current electrical muscle stimulation ("e-stim") with exercise and coaching. Our main program supplements an athlete’s recovery from ACL injury. We coach by video anywhere in the United States and in person in Baltimore by appointment. We may ship a stimulation device to you for use at home. Our services are cash-pay. We do not bill insurance.
Coaching, not medical care
Zach Michael is a coach. He is not a physician, physical therapist, athletic trainer, or other licensed medical provider, unless we tell you otherwise in writing.
Our coaching does not diagnose, treat, cure, or prevent any disease or injury.
Our coaching does not replace care from a physician, surgeon, or physical therapist. If the athlete is in physical therapy, keep going unless the athlete's medical provider says otherwise.
Articles, videos, the white paper, and other content on the Site are for general education only. They are not medical advice for you or your child.
Talking with us, booking a call, or joining a program does not create a doctor-patient or therapist-patient relationship.
If you have a medical emergency, call 911. If the athlete has new or worse pain, swelling, numbness, or instability, stop and contact a medical provider.
Medical clearance and health conditions
Before the athlete starts any program with us, the athlete must get clearance from a physician or other qualified medical provider. This is very important after surgery. You agree to tell us about any surgery, injury, restriction, or health condition that could affect training, and to tell us if anything changes.
Electrical muscle stimulation is not safe for everyone. For example, a person should not use e-stim, or should use it only with a physician's approval, if the person:
Has a pacemaker, defibrillator, or other implanted electronic device.
Is pregnant or may be pregnant.
Has epilepsy or a seizure disorder.
Has an open wound, rash, or damaged skin where the pads go.
Has cancer, or has had cancer, at or near the area to be stimulated.
Has a blood clot, a heart condition, or reduced feeling in the area.
This list is not complete. Ask the athlete's doctor if e-stim is safe for the athlete. We may decline to coach, or may pause coaching, if we think a program is not safe for the athlete.
Who can use our services
You must be at least 18 years old to fill out our forms, book a call, or agree to these Terms.
Many of the athletes we coach are minors. When the athlete is under 18:
A parent or legal guardian must fill out the forms, sign the program agreement, and give consent for the athlete to take part.
The parent or guardian agrees to these Terms for the athlete and is responsible for the athlete's use of the device and the program.
A parent, guardian, or other responsible adult must supervise the athlete when the athlete uses the device at home.
A parent or guardian must be able to join or be nearby for video sessions when we ask.
Assumption of risk
Exercise and e-stim have risks. These risks include muscle soreness, skin irritation or burns from pads, dizziness, strains, re-injury, and, in rare cases, more serious injury.
You and the athlete take part by choice. To the extent the law allows, you accept these risks for yourself and for the athlete. You agree that the athlete will follow our instructions and the device instructions, train within limits, and stop and tell us if something feels wrong. The stimulation device
If we ship or give you a stimulation device, you agree to:
Read and follow the device instructions and our coaching instructions every time.
Use the device only for the athlete enrolled in the program, and only as we direct.
Not open, change, or repair the device, and not use pads or parts that we did not provide or approve.
Keep the device clean, dry, and away from young children, water, and heat.
Tell us right away if the device is damaged, does not work as expected, or causes pain or a skin reaction.
Unless you buy the device, it stays the property of the device manufacturer or Embodi³. You must return it in good condition when the program ends or when we ask. Any deposit, return steps, shipping costs, and charges for loss or damage are as described in your program agreement.
Sessions and scheduling
For video sessions, you are responsible for a safe training space and a working internet connection. Rules for scheduling, rescheduling, and missed sessions are as described in your program agreement.
Payments and refunds
Prices, payment schedules, deposits, and refunds are as described in your program agreement. Prices on the Site or in an email can change, but a change will not affect a program you already paid for. We do not bill insurance and cannot promise that any insurance plan, health savings account, or flexible spending account will pay you back.
No guarantee of results
Every athlete and every injury is different. Results depend on many things, such as the injury, the surgery, how often the athlete trains, and the athlete's other care. We do not promise any result, any recovery timeline, or a return to sport by a certain date.
Testimonials and examples
The Site may show testimonials, stories, and results from athletes and parents. These are individual results. They are not typical, and they are not a promise of what you or your child will get. Some testimonials may be edited for length.
Intellectual property
We or our licensors own the Site and its content, including text, images, videos, logos, the white paper, coaching plans, exercise programs, and the Embodi³ Method. These are protected by copyright, trademark, and other laws.
You may view and print content for your own personal, non-commercial use. You may not copy, share, sell, or publish our content, or make new works from it, without our written permission. All training programs, custom schedules, digital materials, video recordings, and methodologies provided during remote coaching sessions are the proprietary intellectual property of Embodi³ and are protected by applicable copyright laws.
Acceptable use
When you use the Site, you agree not to:
Break any law or the rights of another person.
Give false information, or fill out a form for someone without permission.
Send spam, harmful code, or abusive content.
Try to get into parts of the Site or our systems that you are not allowed to use.
Scrape or copy the Site with bots or other automatic tools.
Record a coaching session without our permission.
We may block access to the Site, or end coaching, if you break these Terms.
Third-party links and services
The Site may link to other websites. We also use other companies to run the business, such as HighLevel (LeadConnector) for booking. Those services have their own terms and privacy policies. We are not responsible for websites and services we do not control.
Disclaimer of warranties
We provide the Site and its content "as is" and "as available." To the extent the law allows, we make no promises of any kind about the Site or its content, including that it will always be available, free of errors, or right for your needs. Any warranty for a device you buy is as described in your program agreement or the maker's warranty.
Limitation of liability
To the extent the law allows, Embodi³, its owners, coaches, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes lost profits, lost data, and lost opportunities.
To the extent the law allows, our total liability for any claim about the Site or our services is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid us nothing.
Nothing in these Terms limits liability that the law does not allow us to limit, such as liability for gross negligence or intentional harm.
Indemnity
You agree to defend and protect Embodi³, its owners, coaches, and staff from claims, losses, and costs (including reasonable legal fees) that come from your misuse of the Site, your misuse of the device, your failure to give true and complete health information, or your breach of these Terms. If you are a parent or guardian, this includes claims that come from the athlete's misuse.
Governing law and disputes
The laws of the State of Maryland govern these Terms, without regard to conflict-of-law rules. If you have a concern, please contact us first. If we cannot solve it together, any lawsuit must be filed in the state or federal courts in Baltimore City, Maryland, and you and we agree to those courts.
Other terms
If a court finds any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, we do not give up the right to enforce it later. These Terms, the Privacy Policy, and your program agreement are the full agreement between you and us about the Site and our services.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. If we make a large change, we will post a notice on the Site or email you. If you keep using the Site or our services after a change, you accept the updated Terms.
