Who we are
Embodi 3 LLC ("Embodi³," "we," "us," or "our") offers coaching that pairs electrical muscle stimulation with exercise and coaching. Our founder and coach is Zach Michael. We coach by video anywhere in the United States and in person in Baltimore, Maryland, by appointment.
This Privacy Policy explains what information we collect when you visit embodi3sports.com (the "Site"), fill out a form, book a call, or join a program. It also explains how we use that information, who we share it with, and the choices you have.
By using the Site, you agree to this Privacy Policy. If you do not agree, please do not use the Site.
A note about health information
Embodi³ is a coaching business. We are not a medical practice, and we are not a health care provider covered by HIPAA. Even so, we know that details about an injury and recovery are personal. When you tell us about an injury, a surgery date, your recovery stage, or your goals, we treat that information with care. We use it only to understand your needs and to deliver coaching. We do not sell it, and we do not use it for advertising.
Information we collect
Information you give us
We collect the information you choose to give us, for example when you:
Join the waitlist or request a trial. Name, email, phone number, ZIP code, whether you are the athlete or a parent or guardian, the athlete's sport, the injury and recovery stage, goals, and focus areas.
Send a contact message. Your name, email, phone number, and whatever you write in the message.
Sign up for the newsletter. Your email address and, if you give it, your name.
Download the free white paper. Your email address.
Book a call. Your name, email, phone number, the time you choose, and any answers you give on the booking form.
Join a program. Contact and billing details, a shipping address if we send you a device, and information you share during coaching, such as progress notes, training history, and feedback.
Please only share what we need to coach you. Do not send medical records unless we ask for them for a specific reason.
Information we collect automatically
When you visit the Site, our systems and our service providers may collect basic technical information. This includes your IP address, browser and device type, pages you view, how long you stay, the site that sent you to us, and general location (such as city or state). We collect this through cookies and similar tools, described below.
Information from other sources
We may receive information from the services we use to run the business, for example a confirmation from our booking calendar or a payment confirmation from our payment processor. We do not receive your full card number.
How we use your information
We use your information to:
Respond to your questions and messages.
Add you to the waitlist and contact you when a spot opens.
Schedule calls, trials, video sessions, and in-person sessions.
Decide if our program is a good fit for the athlete, and build a coaching plan.
Deliver coaching, track progress, and adjust the plan.
Ship, set up, support, and recover a stimulation device.
Process payments and keep business records.
Send the white paper you asked for, and send newsletters if you signed up.
Understand how people use the Site so we can improve it.
Measure our advertising, using general site activity, not your health information.
Protect the Site from spam, fraud, and misuse.
Follow the law and protect our rights.
How we share your information
We do not sell your personal information. We share it only in the ways below.
Service providers
We use other companies to help run the business. They may handle your information for us, and only to do work for us. These include:
Customer relationship management (CRM) and scheduling. We use HighLevel (also called LeadConnector) to store form submissions and contact records, and to run the calendar you use to book a call.
Email. We use an email service, HighLevel to send messages, newsletters, and the white paper.
Payments. A payment processor, Quickbooks, to handle your card or bank details.
Video sessions. We use video platforms, Facetime or Zoom, for remote coaching.
Shipping. If we send you a device, we share your name, address, and phone number with the shipping carrier.
Website hosting and security. Companies that host the Site and protect it from spam, including Cloudflare Turnstile, which checks that a form is sent by a person and not a bot.
Analytics and advertising. Tools such as Google Analytics, Google Tag Manager, and Google Ads, described in the next section.
Other reasons we may share
With your permission. For example, if you ask us to talk with the athlete's physical therapist, physician, or athletic trainer.
With a parent or guardian. If the athlete is a minor, we share coaching updates with the parent or guardian who enrolled them.
For legal reasons. When the law requires it, or to protect the safety of a person, or to protect our rights.
In a business change. If we merge with or sell the business, your information may move to the new owner. This Privacy Policy will still apply to it.
Cookies, analytics, and advertising
Cookies are small files that a website stores in your browser. We and our service providers may use cookies, pixels, and similar tools to:
Keep the Site working, for example to remember a form in progress.
Count visits and see which pages people use, for example with Google Analytics.
Load and manage these tools, for example with Google Tag Manager.
Measure how well our ads work and show our ads to people who visited the Site, for example with Google Ads.
These tools collect general site activity. We do not send your injury details, recovery stage, or other health information to advertising platforms.
You can control cookies in your browser settings, and you can delete them at any time. Some parts of the Site may not work well if you block all cookies. You can also use the Google Analytics opt-out browser add-on and change your ad settings at Google Ad Settings.
Emails and newsletters
If you sign up for the newsletter or download the white paper, we may send you emails about recovery, training, and our programs. Every marketing email has an unsubscribe link. You can also email us to stop. If you unsubscribe, we may still send messages about a program you are in, such as scheduling and account messages.
How long we keep information
We keep information only as long as we need it for the reasons in this policy. For example:
Waitlist and inquiry records: until you ask us to remove them, or for 3 years after last contact.
Client coaching records: for the length of the program and for 1 year after the program ends.
Payment and tax records: as long as tax and business laws require.
When we no longer need information, we delete it or remove the details that identify you.
How we protect information
We use reasonable safeguards to protect your information. These include secure (HTTPS) connections, access limits, and service providers that use industry-standard security. Only people who need your information to coach you or run the business can see it.
No website or online service is 100% secure. We cannot promise that information will never be lost or misused. If we learn of a data breach that affects you, we will tell you as the law requires.
Children and minors
Many of the athletes we coach are under 18. When the athlete is a minor, a parent or guardian must fill out our forms and enroll the athlete. The parent or guardian controls the athlete's information and can use the rights described below for the athlete.
The Site is not directed at children under 13. We do not knowingly collect personal information from a child under 13 without consent from a parent or guardian. If you think a child under 13 sent us information without that consent, please contact us. We will delete it.
Your choices and rights
You can ask us to:
Access the personal information we have about you or your child.
Correct information that is wrong or out of date.
Delete your information. We may need to keep some records, for example for taxes or to settle a dispute.
Stop marketing emails. Use the unsubscribe link, or email us.
Some states, including Maryland, give their residents more privacy rights. These may include the right to get a copy of your data in a portable format, the right to opt out of targeted advertising, and the right to limit how a business uses sensitive data such as health information. These laws apply to businesses of a certain size, and they may not all apply to us. We will still honor a reasonable request where we can, and we will not treat you differently for making one.
To make a request, email support@embodi3sports.com. We may need to confirm your identity before we act. We will reply within the time the law requires, and in most cases within 45 days. If we say no to a request, we will tell you why and how to appeal.
Links to other websites
The Site may link to other websites and services, such as social media pages or our booking calendar. Those sites have their own privacy policies. We are not responsible for how they handle your information.
Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date at the top. If we make a large change, we will post a notice on the Site or email you. If you keep using the Site after a change, you accept the updated policy.
